These terms govern your use of the Peak application. Section 1 contains important health and safety information which you should read in full before using the application.
Peak is not a medical device and does not provide medical advice. It is a tool for recording and planning your own training. No element of the application — including the training programs it provides, the exercise instructions it displays, the set and repetition targets it suggests, and any recommendation it generates — constitutes medical advice, diagnosis or treatment, or a substitute for consultation with a qualified health professional.
Consult a physician before beginning any exercise program. This is particularly important if you are pregnant, are recovering from injury or surgery, have a cardiac condition, elevated blood pressure, joint conditions or any other medical condition, or have been physically inactive for an extended period.
Resistance training carries an inherent risk of injury. You undertake all training at your own risk. Discontinue exercise and seek medical attention immediately if you experience chest pain, dizziness, faintness, shortness of breath or acute pain. Use appropriate safety equipment and, where relevant, a spotter for heavy loads. Do not attempt a load or movement for which you are not adequately prepared, irrespective of any suggestion made by the application.
Recommendations are generic and are not adapted to your medical circumstances. Training programs are matched to the objectives, experience level, schedule and equipment you record. They are not informed by your medical history, which Peak does not request and does not hold.
Energy expenditure figures are third-party estimates. Any calorie or energy value displayed is derived from an external exercise database and reflects population averages. It is not a measurement of your body and must not be relied upon for medical or dietary decisions.
You remain responsible for your own safety and for all decisions concerning your training.

You must be at least 13 years of age to use Peak, or at least 16 if you are resident in a European Economic Area member state that specifies a higher age of consent. By registering an account you confirm that you meet the applicable age requirement. Peak is not designed for, nor marketed to, children.
Peak is distributed through the Apple App Store. Your licence to use the application is Apple's Licensed Application End User License Agreement (the "Standard EULA"), available at apple.com/legal/internet-services/itunes/dev/stdeula/. No separate or bespoke licence applies. These terms supplement the Standard EULA in respect of the matters it does not address, including the health and safety notice in section 1.
Peak is provided free of charge. It contains no in-application purchases, no subscriptions and no advertising.
You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account. The training programs, workout templates, notes, custom exercises and records you create remain yours; Peak stores and synchronises them so that they are available across your devices, and asserts no ownership over them. The processing of that data is described in the Privacy Policy.
You may delete your account and all associated data at any time from Settings → Account → Delete Account.
You must not use Peak for any unlawful purpose; attempt to disrupt, overload or gain unauthorised access to the service or to the data of other users; reverse engineer the application, save to the extent expressly permitted by applicable law; or extract, reproduce or redistribute the exercise database or its associated media. Access may be suspended or terminated in the event of any such conduct.
The exercise library — including exercise names, descriptions, instructions, translations, images and animations — is licensed from a third-party provider and remains that provider's property. It is made available for use within the application only and may not be extracted or redistributed.
The application additionally offers links to exercise videos hosted on external platforms. Those services are not operated by Peak, their content is neither reviewed nor endorsed, and their own terms and privacy policies govern your use of them once you leave the application.
Peak is an independent project maintained by a single developer. The service may be modified, suspended or discontinued at any time, and features may be added or withdrawn. Reasonable efforts will be made to give advance notice of material changes, but no particular level of availability is warranted. Because the application functions offline and retains your data on your device, your training records remain accessible locally in the event that the service is unavailable.
Peak is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. No warranty is given that the application will be error-free, uninterrupted or free from data loss. You are advised to retain independent records of any information you cannot afford to lose.
To the fullest extent permitted by applicable law, the provider shall not be liable for any indirect, incidental, special, consequential or punitive damages, for loss of data, or for any injury, health consequence or loss arising from your use of the application or from any training you undertake. Where liability cannot lawfully be excluded, it is limited to the amount paid by you for the application, which is nil.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded. If you are a consumer, you retain all mandatory statutory rights conferred by the law of your country of residence, and nothing in these terms operates to override them.
These terms are governed by the laws of the Eastern Republic of Uruguay, without regard to its conflict-of-law rules. If you are a consumer resident elsewhere, this provision does not deprive you of the protection afforded by the mandatory laws of your own country.
These terms may be amended from time to time. The date shown above records the most recent revision, and the current version is always published at this address. Continued use of the application following an amendment constitutes acceptance of the revised terms.
